North East Borough Schedules Hearing on Proposed Water, Sewer, and Garbage Rate Ordinances

The Borough of North East hereby gives notice that the Borough Council for the Borough of North East, Erie County, Pennsylvania, at its regular meeting for the month of December on December 19, 2022 commencing at 6:00 p.m. prevailing time at the Borough Hall, 31 West Main Street, North East, PA 16428, will conduct a public hearing upon the proposed Water, Sewer, and Garbage Rate Ordinances set forth herein below.

ORDINANCE NO. 921 amending ordinances No. 900, No. 904, and No.919 establishing water rates.

Be it ordained and enacted by the Borough of North East, and it is hereby ordained and enacted by authority of the same.

Ordinance No. 900, No. 904 and No. 919 is hereby amended as follows:

SECTION 1: Section 2 – Water Rates, is amended by deletion of the existing section, which shall remain effective through March 31, 2023 and substitution therefore, the following as of April 1, 2023:

WATER RATES:
2.1 The water rate charged to and payable by water rate customers of and from April 1, 2023 is and shall be: $3.79 per 100 cubic feet ($5.05 per 1000 gallons). The minimum billing for each water rate customer per billing period after April 1, 2023 shall be for 500 cubic feet, or 3,740 gallons, notwithstanding that the metered consumption is less than 500 cubic feet or 3,740 gallons.

SECTION 2: Except as specifically amended herein, all provisions of Ordinance No. 900, No. 904, and No. 919 shall remain in full force and effect.

SECTION 3: The within Ordinance shall be effective immediately with the subject rate change effective as of the date set forth.

ORDINANCE NO. 922 amending ordinance No. 899, 905, 910 and 920 establishing sewer rates. Be it ordained and enacted by the Borough of North East, and it is hereby ordained and enacted by authority of the same.

Ordinance No. 899, No. 905, No. 910 and No. 920 are hereby amended as follows:
SECTION 1: Subsections 2.1, 2.1.1, 2.1.2, 2.1.3, and 2.2 are hereby amended effective March 31, 2023 by deletion of the said subsections and substitution therefore, the following as of April 1, 2023

SEWER RATES
2.1 The sewer rate charged to and payable by each sewer rate customers, except the Township, of and from April 1, 2023 shall equal the sum total of the following:
2.1.1 Flow Charge: $4.60 x flow (total measured in gallons) ÷ 1000; Plus
2.1.2 BOD Charge: $0.58 (concentration measured in parts per million) x flow (measured in million gallons) x 8.34; Plus
2.1.3 TSS Charge: $0.40 x TSS (concentration measured in parts per million) x flow (measured in million gallons) x 8.34.
2.2 The sewer rate charged to and payable by the Township of and from April 1, 2023 shall be calculated as set forth in Section 2.1 above and then multiplied by a factor, 1.00.

SECTION 2: Except as specifically amended herein, all provisions of Ordinance No. 899, No. 905, No. 910 and No. 920 shall remain in full force and effect.

SECTION 3: The within Ordinance shall be effective immediately with the subject rate change effective as of the date set forth.

ORDINANCE NO. 923 amending ordinance no. 901 and no. 911 prohibiting the accumulation of garbage and household refuse; regulating the Collection and disposal of garbage and household refuse; and imposing charges for collection thereof and providing penalties for the violation of this ordinance. Be it ordained and enacted by the Borough of North East, and it is hereby ordained and enacted by Authority of the same.

Ordinance No. 901 and No. 911 are hereby amended as follows:

SECTION 1: Subsections 7.1, 7.2, 7.3 and 7.4 are hereby amended effective March 31, 2023 by deletion of the said subsections and substitution therefore, the following as of April 1, 2023

GARBAGE RATES
Section 7- Rates: The rates of charge for collection and disposal of garbage/household refuse either by collection of the garbage/ household refuse at the curb or by means of disposal unit discharging into the sanitary sewer system of the Borough or by combination thereof, and for collection and disposal of garbage/ household refuse shall be as follows:

7.1 A single family dwelling – $90.00/ Quarter (Payable as billed)
7.2 A multiple family dwelling – $90.00/ Quarter/ dwelling unit (Payable as billed)
7.3 A commercial activity which is any activity producing garbage/household refuse in excess of that normally produced by either of the above two (2) categories and/or is for commercial purposes, shall pay $120.00/ Quarter. Contractors and other parties requesting intermittent service shall be charged a flat rate for each placement and removal of a dumpster as determined be the resolution of the Borough Council from time to time.
7.4 Dumpsters provided to residential or commercial customers will be billed based upon placement and/or removal and dumping of each size dumpster. The fees per dumpster differentiation are listed as below and may be modified from time to time by the resolution of the Borough Council. 4 Cubic Yard Dumpster- $160.00/ Removal and/or dumping; 6 Cubic Yard Dumpster- $200.00/ Removal and/or dumping

SECTION 2: Except as specifically amended herein, all provisions of Ordinance No. 901 and No. 911 shall remain in full force and effect.

SECTION 3: The within Ordinance shall be effective immediately with the subject rate change effective as of the date set forth.
