Notice of Intent to Re-Issue Title V Operating Permit #25-00923 In accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection (Department) intends to re-issue a Title V Operating Permit to Erie Power, LLC for its North East Cogeneration facility located at 10915 Ackerman Lane, in North East Township, Erie County.

Erie Power’s representative to contact concerning this application is Mr. Yaniv Cohen, Managing Member, 131 Varick St., Suite 1006, New York, NY 10013-1410. His phone number is (646) 632-4555.

This facility produces electricity for sale to the grid. The facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments due to the facility’s potential to emit nitrogen oxides (NOx) and carbon monoxide (CO). The facility is therefore subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapter G.

The facility’s major emission sources include the two (2) existing 35 MW natural gas-fired combustion turbines and miscellaneous natural gas usage. The turbines are subject to 40 CFR 60 Subpart GG Performance Standards for Stationary Gas Turbines. The turbines are also subject to CSAPR (Cross State Air Pollution Rule) requirements of 40 CFR Part 97, Subparts AAAAA, CCCCC, and EEEEE. The turbines and a 5.5 mmBtu/hr space heater are subject to presumptive RACT requirements for NOx under 25 Pa. Code §129.97. The potential emissions of the major pollutants from the facility after permit limits are as follows: 244.56 TPY (tons per year) NOx, 223.55 TPY CO, 33.74 TPY VOC, 6.31 TPY total HAPs (hazardous air pollutants), 43.05 TPY PM-10 and PM-2.5, and 5.22 TPY SOx.

Copies of the application, the Department’s analysis and other documents used in the evaluation of the application are available for public inspection during normal business hours at the Department of Environmental Protection, 230 Chestnut Street, Meadville, PA 16335. Any person wishing to provide the Department of Environmental Protection with additional information that they believe should be considered prior to the issuance of this permit may submit the information to the Department at the address shown above.

A 30-day comment period, from the date of this publication, will exist for the submission of comments. Each written comment must contain the following information:

  • Name, address and telephone number of the person submitting the comments.
  • Identification of the proposed permit (specify Permit # TV 25-00923)
  • Concise statements regarding the relevancy of the information in the proposed permit or objections to issuance of the permit.

A public hearing may be held, if the Department, in its discretion, decides that such a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or by the Pennsylvania Bulletin, or by telephone, where the Department determines such notification by telephone is sufficient. Written comments or requests for a public hearing should be directed to Mr. Eric A.
